ARTICLE V – FISHING
​
  1. One person must display the Association Button, preferably on a hat, but, if no hat is worn, it must be prominently displayed on the shirt or coat.
  2. The Pennsylvania Fish and Boat Commission regulations mandate the size and creel limit for all species. The Paupackan Lake Association reserves the right to impose stricter size and creel limits as posted at the boat basins.
  3. Fishing is not permitted within fifty (50) feet of the beach and swimming area. Fishing is permitted beyond the spillway toward East Shore Drive.
  4. The use of the lake is at one’s own risk.

Welcome to the Paupackan Lake Association (the "Association") website, also known as the "Site." The primary goal of this Site is to provide a safe, decent, fair and effective platform for intracommunity communication in electronic interaction. We welcome people from our community association who which to share information, experiences and opinions. The term "Neighbors" refers to residents or owners of homes with the Paupackanl Lake Community who have registered as users of this Site. In the spirit of kindness, tolerance and good manners, all Neighbors shall abide by the following code of conduct, and comply with the terms and conditions set forth herein ("Terms of Use Policy"). When you join and use the Site, you agree that you have read and will follow the rules provided below.

Good Neighbor Conduct.  The Site is intended for use by Neighbors who are over 18 years of age.  By submitting comments, you certify that you are at least 18 years of age.  We welcome people of all races, religions, genders, national origins, sexual orientations and point of view.  We do not tolerate expressions of bigotry, hatred, harassment or abuse, nor will we tolerate threats of harm to anyone as determined by the Board of Directors for the Association in its sole and absolute discretion.  Because we encourage discussion and the exchange of ideas, we do not allow defamatory, threatening, unlawful, abusive, tasteless, embarrassing, vulgar or indecorous content or statements.  For the same reason, we do not allow sexually explicit or obscene material on this Site, nor links to such material.  Notwithstanding the foregoing, it is expressly agreed, by participation in this Site that the Association is not responsible for any content posted by Neighbors, and Neighbors are solely and individually responsible for the quality and accuracy of any content they may post on this Site.  Users of this Site shall not impersonate another person or otherwise misrepresent their identity or affiliation.  Users shall also not allow any other person or entity to use or his or her identification for posting comments.

Ownership of Copyright and Intellectual Property.  All materials found on the pages of this website are protected under the copyright laws of the Unites States and of other countries.  Certain names, words, titles, phrases, logos, icons, graphics or designs in the pages of this website may constitute trade names, trademarks or service marks of the Association or the Association’s agents or the use of which may have been licensed to them.  The display of trademarks, trade names or service marks on pages at this Site does not imply that a license of any kind has been granted to anyone else.  Any unauthorized downloading, retransmission, republication or other copying or modification of material posted on this website, including trademarks, trade names, and service marks, may violate federal, state, trademark law and copyright law, and may result in legal action.  Users shall not post comments that infringe on the rights of any third party, including intellectual property, privacy or publicity rights.

No Illegal Activities.  Illegal activities are prohibited. Specifically, you shall not use the Site to advocate illegal conduct or participate in illegal or fraudulent schemes. You shall also not use the Site to distribute unauthorized copies of copyrighted material, including photos, artwork, text, recordings, designs or computer programs. In addition, you will not post, or use, computer programs that contain destructive features, such as malware, viruses, worms, Trojan horses, bots scripts, spyware, invasive or privacy-invasive software, and any other forms of software or spam.

Communication Services.  This Site may contain bulletin board services, chat areas, forums and/or other message or communication tools designed to enable Neighbors to communicate with the public at large or with a group (collectively, “Communication Services”). Postings to and transmission between parties via the Communication Services are not reviewed prior to appearing on the Site. We reserve the right to remove messages that are flagged as inappropriate by any Neighbors that express concern. If you see a comment that violates the rules as set forth in this disclaimer, please contact the Association.  The Association reserves the right to edit, move, or delete any postings on the Communication Services, and to immediately terminate or suspend access to the Site for conduct that interferes with other Neighbor’s enjoyment of the Site.  By posting any comments on the Site, you give the Association the irrevocable right to reproduce, distribute, publish, display, edit, modify, create derivative works from, and otherwise use your comments for any purpose in any form and on any media.

The Site may provide forums that cover a number of topics; however, the Site’s staff and Neighborhood moderators do not offer professional advice of any kind and are speaking from their own experience or opinion as is helpful for the facilitation of conversation. Such personnel claim no professional expertise or authority. We do our best to encourage comfort and discourage disruptive communication. We also discourage disruptive statements that incite others to violate our standards. We encourage your participation in upholding our standards. When in doubt about appropriate behavior here, remember that although the Site is a virtual community, the people here are real. So, just as when you join any gathering of people, we ask that you treat others with mutual respect and with care.

Links to Third Party Sites and Advertisements.  Solely as a courtesy to you, we provide links to other websites at certain places on our Site; however, we do not endorse, approve, certify or control any of those websites.  Because we do not have any control over such websites, you acknowledge and agree that we are not responsible for the content of the websites or the availability, accuracy, completeness, efficacy, or timeliness of information contained on those websites. In addition, we are not and will not be responsible for webcasting or any other form of transmission received from any linked website. Use of those websites or any information obtained from those websites is voluntary, and reliance on it should only be undertaken after an independent review of its accuracy, completeness, efficacy and timeliness. Security.  The exchange of information such as passwords or electronic mail, between the Site and Neighbors, may not be secure given the structure of the Internet. Consequently, although this Site may have standard security measures in place that are intended to protect against the loss of information that we collect, you should keep in mind that this Site is run on software, hardware and networks, any component of which may, from time to time, require maintenance or experience problems or breaches of security. The Site encourages Neighbors to change their passwords frequently. Each Neighbor is responsible for protecting the privacy of his/her password. Passwords can be modified, updated or changed at any time.  Postings and other communications with the Site are not private and may be published and edited at the discretion of the Site.

Indemnification.  All comments posted on the Site are the responsibility of the commenter, not the Association, the website administrator, contributor, editor, or the author of any other post or any other commenter. By submitting a comment to the Site, you agree (a) either the comment content is your own or you have the permission of others who have contributed to or are featured in any comment you submit to post such comment, and (b) to indemnify the Association and its directors, officers, employees, and agents from and against any and all losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any claim brought by any third party relating to your breach of these rules, violation of the law by your comments, the content of any comment you have submitted, or your use of the Site.
